This website is operated by The Cosy Daisy Company Limited, trading as The Cosy Daisy Company. Throughout the site, the terms “we”, “us” and “our” refer to The Cosy Daisy Company Limited.
These Terms and Conditions apply when you use our website or purchase products from us. Please read them carefully before placing an order.
Nothing in these Terms and Conditions affects your statutory rights as a consumer.
OUR PRODUCTS
We take reasonable care to describe and photograph our products as accurately as possible.
Colours may appear slightly different depending on lighting, photography and individual screen settings.
Many of our handmade and personalised products are created individually rather than mass-produced. Small variations in colour, pattern, flower or decorative-element placement, and the distribution of materials such as glitter or resin inclusions are natural characteristics of handmade products and make each piece unique.
These natural variations are not normally considered faults. This does not affect your rights if an item is faulty, significantly different from its description or does not reasonably match an approved design.
PERSONALISED AND MADE-TO-ORDER PRODUCTS
When ordering a personalised product, you are responsible for checking that the information you provide, including names, wording, dates, colours and other requested details, is correct.
Where we provide a design proof, please check it carefully before approving it. Production will normally begin after your approval.
Once a personalised or made-to-order product has entered production, changes or cancellation may not be possible.
Personalised and custom-made products cannot normally be returned or exchanged simply because you have changed your mind. This does not affect your rights where an item is faulty, damaged, incorrectly supplied or does not reasonably match an approved design.
ORDERS
When you place an order, you are making an offer to purchase the products in your order.
We reserve the right to refuse or cancel an order where reasonably necessary, for example where a product is unavailable, there has been an obvious pricing or description error, we are unable to obtain payment, or we cannot fulfil the order.
If we cancel an order after payment has been taken, we will refund the amount paid.
PRICES AND PAYMENT
Prices are displayed in pounds sterling (GBP).
The price payable is the price shown at checkout when you place your order, together with any applicable delivery charges.
Payment must be successfully authorised before we process your order.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error after an order has been placed, we will contact you before fulfilling the order and give you the option of proceeding at the correct price or cancelling the order for a refund.
DELIVERY
We currently deliver to UK addresses only.
Delivery charges and available delivery options are shown at checkout.
Preparation and dispatch times vary depending on the type of product ordered. Ready-made items and personalised or made-to-order items may have different preparation times.
Where an order contains products with different preparation times, we may dispatch the complete order together once all items are ready.
Delivery dates and carrier transit times are estimates and cannot be guaranteed. Please see our Delivery & Returns policy for further information.
RETURNS, CANCELLATIONS AND REFUNDS
Your rights to cancel an order, return eligible products and receive a refund are explained in our Delivery & Returns policy.
For eligible non-personalised goods purchased online, you generally have the right to tell us that you wish to cancel within 14 days of receiving the goods, followed by a further 14 days to return them.
Certain products, including goods made to your specifications or clearly personalised for you, are generally excluded from change-of-mind cancellation rights.
Nothing in these Terms and Conditions limits your statutory rights in relation to faulty, damaged, misdescribed or incorrectly supplied goods.
PRODUCT AVAILABILITY
All products are subject to availability.
We may withdraw products, change product details or limit quantities available for purchase where reasonably necessary.
If we are unable to supply something you have ordered, we will contact you and refund any amount paid for the unavailable item.
WEBSITE USE
You may use our website for lawful personal shopping purposes.
You must not misuse our website, attempt to interfere with its operation or security, introduce malicious software, or use the website for fraudulent or unlawful purposes.
Content on this website, including our branding, original photographs, designs, graphics and written content, may be protected by intellectual property rights and must not be copied, reproduced or commercially used without permission where those rights belong to us.
THIRD-PARTY SERVICES
Our website may use or provide access to services operated by third parties, including payment providers and delivery providers.
Those third parties may have their own terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.
Our online store is hosted using Shopify.
PRIVACY
We handle personal information in accordance with our Privacy Policy.
Information may be processed by service providers where necessary to operate our online shop, process payments, fulfil orders and provide our services.
OUR RESPONSIBILITY TO YOU
We do not exclude or limit liability where it would be unlawful to do so.
Nothing in these Terms and Conditions excludes or restricts our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly or mainly for personal use.
EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delays or failure to perform our obligations where caused by circumstances outside our reasonable control.
If such circumstances significantly affect your order, we will contact you where reasonably possible and take appropriate steps to minimise the effect.
CHANGES TO THESE TERMS
We may update these Terms and Conditions from time to time, for example to reflect changes to our business, website or applicable law.
The Terms and Conditions applying to an order will normally be those in force when the order was placed.
GOVERNING LAW
These Terms and Conditions are governed by the laws applicable in the United Kingdom jurisdiction in which you live.
If you are a consumer, you retain the benefit of any mandatory protections provided by the law applicable to you and may bring legal proceedings in the courts available to you under applicable law.
